Please use a clear (e.g., times new roman, arial, courier) 12 point font and one inch margins on all four sides.

The assignment itself: You may write your paper on one of the following three topics:
1. An in-depth analysis of United States v. Jones, 565 U.S. ___ (2012) and the Fourth Amendment case law leading up to Jones. Specifically, what cases did Jones overturn, either entirely or in part? How did Jones affect the applicability of the Fourth Amendment?
2. Research the case law and statutory law behind self-defense and the use of deadly force. What does the case law reveal that an average citizen can use in terms of self-defense and deadly force? How is that different than what a law enforcement officer can do? Provide a detailed analysis of the case law in which the courts have grappled with these issues. Focus primarily on the Supreme Court cases on this issue.
3. Research, summarize, and analyze the most recent US Supreme Court opinions that address criminal law matters, such as ineffective assistance counsel, probable cause and Fourth Amendment challenges. Of these recent Supreme Court cases, which cases were overturned? How has the case law evolution led up to this point and how might it be affected in the foreseeable future? What are the practical implications of these recent Supreme Court decisions?
4. Finally, if you are very interested in researching another criminal law topic, please send me a message by the end of Week 3 to seek approval for your topic. Otherwise, please choose from among the three above topics.
No matter your selected topic:
explain whether your selected topic is (or should be) a public policy-related matter, and why.
use effective, well-designed search strategies and tools to efficiently and creatively refine searches, on the fly as needed
apply multiple criteria to assess relevance, currency, authority, accuracy, purpose, audience and ideological perspectives related to your topic.
look for statistical evidence that either supports or detracts from the criminal law-related challenges that you address, and explain its relevance and value to your selected topic.
clearly and effectively communicate, organize, and synthesize complex and often contradictory information to advance graduate level scholarly knowledge about your selected topic.
Quote, paraphrase, and cite information correctly and consistently, always using information in ways that are true to the original context.
Your paper should be 8-10 pages. Here are some general guidelines. Please use a clear (e.g., Times New Roman, Arial, Courier) 12 point font and one inch margins on all four sides. Please include page numbers. Please double space. I recommend using topic and sub topic headings to organize your paper.
Please apply Bluebook citation style (which uses footnotes) if you are a Legal Studies student. If you are not a Legal Studies student, you may use APA style, which uses end notes in a reference page at the end of your research paper.
It is fine for the total paper to be at 10 pages, including the title page, abstract and references. That being said, if the paper is 10 pages in length and then another few more pages with those items, that is fine too. What I’m really looking for in the paper is graduate level cohesive writing in which you research and analyze primary legal sources, such as case law, statutes and the US Constitution.
Write an introduction, which clearly identifies the topic of your report and the issues which you seek to illuminate. The introduction should include the thesis statement (or basis of your report), and a very preliminary overview of the evidence you will use to support it. Finally, the introduction should include a statement that identifies why is the topic of your report important.
2. The body of your report should be dedicated to supporting your thesis statement with claims gleaned from your research (into what others have written on the topic; data that you have gathered), readings from the course text, discussions, and/or case law, law review articles, etc.
3. Conclude your report by recapitulating your thesis statement and explaining in greater detail the significance of your findings. Include in your conclusion some questions or claims about the topic and/or specific which you’ve written. If you believe more research needs to be done on your topic, be specific about what kind of research and how you think it ought to be done.
Upload your papers in the Assignment section of the classroom. Your paper will automatically be processed through Turnitin.
Your paper is due at the end of the 6th week of the course. Week 6 will be here before you know it. I will take points off for late submissions so please turn your paper in by midnight on Sunday of Week 6. I will also do my best to grade the paper asap as they come in, so if you want to turn your paper in early, I’ll do my best to grade it quickly.
I recommend that you proofread your paper several times to ensure that you have no spelling, grammar or punctuation errors and that your paper flows well and is organized.

Defend your answer with the required elements of the crime.

After reading this week’s chapter (4) in the E-Text and the required resources please discuss the following:
What is a conspiracy? What are the required elements of a conspiracy?
Based on the fact pattern below can Maria be charged with solicitation, conspiracy or attempt? Defend your answer with the required elements of the crime.
What about Sam? Defend your answer with the required elements of the crime.
Maria’s boss has been on her case for the past month because she missed an important deadline which caused the company to lose a major client. On Friday, after he yelled at Maria again, Maria left work and went to the local bar to have a drink. While there she met a friend, Samuel, who is also a drug dealer. Maria vented to him about how her boss was a real jerk and how she wished he was dead. In a drug induced haze and drunken state, Sam and Maria made several jokes about how Maria could make her boss disappear. The next evening, Maria is at Shoprite and she saw her boss in a deserted, dark area of the supermarket parking lot. She thought about running him over with her car and looked around for video cameras. As Maria was in the car thinking about running her boss over with the car, a police officer approached and told her to move her car because she was in a ‘no standing” zone. Explain your answer by identifying which elements are present or missing.

What rule did they come up with?

In Terry v. Ohio, See Terry v. Ohio, 392 U.S. 1 (1968), the Supreme Court dealt with the issue of investigative detentions and limited searches; that is, allowing the police to stop, detain and engage in a limited search of a person with no probable cause to do so.

Take a few moments to look up the Terry v. Ohio case see: Terry v. Ohio, 392 U.S. 1 (1968).
What did the court say?
What rule did they come up with?
What are the key requirements?
Should the Court have allowed these stops in order to find evidence of crimes?
Should a police officer have the right to say, “I’m going to stop that person because I have a sneaking suspicion they’re up to no good.” Or does this give police too much power and authority that could be used in an arbitrary and capricious manner?
What are the long-term consequences of allowing this type of action and is the price worth it? Why or why not?
Are there any real-life events that come to mind on point? Are there any cases other than Terry v. Ohio on point?

Your introduction paragraph needs to end with a clear thesis statement that indicates the purpose of your paper.

Prior to beginning work on this assignment, watch Crimes of the Powerful, available through the Films on Demand database in the University of Arizona Global Campus Library. I have attached the link below as well (please let me know if it does not open).
https://fod-infobase-com.eu1.proxy.openathens.net/p_ViewVideo.aspx?xtid=47476&loid=137445&tScript=0
Additionally, read Chapters 5 and 6 from the textbook (attached). Our justice system tends to focus on street crime, often ignoring much more significant problems such as white-collar, corporate, and state crime. The video linked above also discusses euthanasia, although the point of this reference is to illustrate how the law can be used as a tool for social change. The video also discusses moral values with a focus on media coverage of harm to children. Laws have changed in direct response to these incidents and the resulting media coverage. In effect, this coverage becomes an engine for social change. The video ends with a discussion of crime theory, reminding us that many criminological theories fall short when applied to people with wealth and high status. Write a paper discussing the myths and realities of crime.
In your paper,
-Imagine asking 100 strangers to describe a criminal.
-Predict whether those descriptions would be likely to focus on street criminals or the variety of topics covered in the Crimes of the Powerful
-Evaluate how society defines crime. Do not provide a definition – instead, explain how the definition is reached.
-Present a clear statement about a particular crime, something we know to be absolutely true. Illustrate how we know that this is an accurate statement.
-Present an example of a widely-held myth or misconception about crime and society. Determine how we know that this is a myth. Explain why this myth is so difficult to abandon.
The Myths and Reality of Crime paper:
-Must be three to four double-spaced pages in length (not including title and references pages) and formatted according to APA style.
-Must include a separate title page with the following:
Title of paper
Student’s name
Course name and number
Instructor’s name
Date submitted
-Must utilize academic voice
-Must include an introduction and conclusion paragraph. Your introduction paragraph needs to end with a clear thesis statement that indicates the purpose of your paper.
-Must use at least four scholarly sources, in addition to the course text. Course text needs to be cited in the paragraphs as follows: (Collica et al., 2020, page # and/or chapter with section number)
Cite the chapters on the reference page as follows: Collica, K. & Furst, G. (2012). Crime & society. Retrieved from https://content.uagc.edu
-Must document any information used from sources in APA style
-Must include a separate references page that is formatted according to APA style
